U.S. Ports Emergency Surcharge

As announced by the Ports of Los Angeles and Long Beach under the direction of Biden-Harris Supply Chain Disruptions Task Force, there will be an Emergency Surcharge put into place effective on Nov 1, 2021. The ocean carriers will begin to assess the penalty as from November 15th, 2021.

To help you understand better this new government issued implementation, please take note of the following guidelines:

  • The Port Authority Los Angeles & Long Beach will be assessing this
  • Both ports will start charging the Ocean carriers an additional fee for import containers which have been sitting idle on the terminal for 9 days for local delivery and 6 days for all rail cargo departing the port for inland location.
  • MWL Ltd will pass through this Emergency Surcharge to the Bill Lading consignee when it is incurred. The quantum starts at U$100 per container, increasing in U$100 increments per container per day of excess dwell time beyond the prescribed dwell period. Please refer to the attached table below.
  • There is no maximum fee that will be applied and will continue to accrue until the container is off the terminal. Containers on hold for Customs Exam are subject to the fee.
  • Local store door truck moves will also fall within the chargeable items under this fee. Lack of chassis will not exempt the fee.
  • “No new surcharge” clauses in contracts, NSA or NRA do not exempt this fee as it is a government mandated fee.


Container Excess Dwell Fee Structure:

The daily charge will be counted per calendar day on the terminal beyond the defined dwell times including weekends and holidays.

Local import excess dwell fee begins on day 9 as follows:
